Terms of Service
The terms and conditions that govern your use of Pomnex's website and services.
Last updated: July 31, 2026
These Terms of Service ("Terms") govern your access to and use of the Pomnex website and our WordPress operations services, including maintenance, monitoring, custom plugin development, and related offerings (together, the "Services"). By using our website or requesting our Services, you agree to these Terms. If you do not agree, please do not use our website or Services.
1. About Pomnex
Pomnex is a WordPress operations company. We operate, maintain, monitor, and develop custom systems for WordPress websites. Pomnex is not a web hosting provider, design agency, or marketing or SEO agency. Our Services relate specifically to the operational stability, security, and custom development of WordPress systems.
2. Requesting Our Services
You may request our Services through our contact form, quote request form, or by messaging us directly on Telegram or WhatsApp. Submitting a request does not automatically create a binding agreement. A service engagement begins only once we confirm the scope, pricing, and timeline with you, whether in writing or through an agreed proposal.
3. Quotes, Pricing & Payment
Quotes provided through our website or in conversation are estimates based on the information you share, and may change once we review your project or site in detail. Unless otherwise agreed in writing:
- Payment terms, currency, and schedule will be confirmed with you before work begins.
- Prices do not include third-party costs such as hosting, domain registration, premium plugins, or licenses, unless explicitly stated.
- Late or missing payments may result in a pause or termination of Services.
- A customer's first maintenance subscription carries a 30-day money-back guarantee: if you ask within 30 days of the service starting, we refund the amount paid for that subscription in full. The guarantee does not apply to renewals, later subscriptions, or custom development work.
4. Client Responsibilities
To deliver our Services effectively, we may ask you to:
- Provide accurate and complete information about your website, hosting environment, and project requirements.
- Grant timely and appropriate access credentials (e.g., WordPress admin, hosting, or FTP access) needed to perform the work.
- Maintain your own backups or authorize us to create them, and keep a valid hosting plan and domain registration active.
- Review and respond to our communications in a timely manner so project timelines are not delayed.
5. Maintenance, Monitoring & Uptime
For active maintenance and monitoring plans, we apply safe and regular updates, perform reliable backups, and monitor your site to detect and address issues proactively. While we work to keep your site secure, fast, and always running, including any uptime commitment stated in your specific plan, we cannot guarantee uninterrupted availability, as this can also depend on factors outside our control, such as your hosting provider, third-party plugins, DNS, or force majeure events.
6. Custom Development & Intellectual Property
For custom plugins or systems we build specifically for you, ownership of the final delivered code transfers to you upon full payment, unless otherwise agreed in writing.
Pomnex retains ownership of its pre-existing tools, frameworks, internal libraries, and general know-how used to build your project, and may reuse non-client-specific components in future work.
You are responsible for ensuring you hold the necessary rights or licenses for any content, branding, or third-party plugins you ask us to integrate.
7. Acceptable Use
When using our website or Services, you agree not to:
- Submit false, misleading, or fraudulent information through our forms or communication channels.
- Attempt to disrupt, overload, or gain unauthorized access to our website, systems, or client sites.
- Use our Services for any unlawful purpose or to develop or maintain content that is illegal, harmful, or infringes on the rights of others.
8. Confidentiality
We treat the information you share with us, including credentials, business details, and project information, as confidential, and we use it only to deliver the Services you requested. We expect the same discretion regarding any non-public information we may share with you about our tools, pricing, or processes.
9. Third-Party Services & Tools
Our Services may rely on or interact with third-party providers, such as hosting companies, plugin developers, payment processors, or communication platforms (e.g., Telegram, WhatsApp). We are not responsible for the availability, performance, or policies of these third-party services.
10. Disclaimer of Warranties
Our website and Services are provided on an "as is" and "as available" basis. While we apply professional care and industry best practices, we do not warrant that our Services will be completely error-free, uninterrupted, or that every security risk will be eliminated. Any specific service-level commitments, such as uptime guarantees, apply only as stated in your individual service plan or agreement.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Pomnex will not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or business opportunities, arising from your use of our website or Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the specific service giving rise to the claim.
12. Termination
Either party may end an ongoing service engagement by providing reasonable written notice, subject to any specific terms agreed for that engagement, such as a notice period or outstanding invoices. We may also suspend or terminate access to our Services if you breach these Terms or misuse our website.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services or for legal and operational reasons. We will post the updated version on this page with a revised "Last updated" date. Continuing to use our website or Services after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law & Disputes
These Terms are governed by the laws applicable to Pomnex's operations, without regard to conflict-of-law principles. We encourage resolving any disagreement directly with our team first; if a dispute cannot be resolved amicably, it will be handled in accordance with applicable law.
Questions about these Terms? Reach out and our team will be glad to clarify anything.
